VA expands review of Camp Lejeune cases

In August 2012, President Obama signed into law the Honoring America’s Veterans and Caring for Camp Lejeune Families Act of 2012, also called the Janey Ensminger Act. This act provides healthcare to the Camp Lejeune military residents during the period of 1957 to 1987 who developed certain diseases.

Janey, the nine-year-old daughter of Jerry Ensminger died of leukemia in 1983.  They were Camp Lejeune residents during the 1957 to 1987 period. Sgt. Ensminger, a retired veteran, was instrumental in pushing for water contamination investigation and legislation to assure victims received VA healthcare. With the passing of this recent law, veterans have better chances for obtaining favorable responses to their Camp Lejeune water contamination claims. The law provides that people who lived at Camp Lejeune for at least 30 days between 1957 and 1987 have the right to hospital and medical services, if they experienced any of 14 diseases and conditions listed in the act.

Cases & compensation — studies finding Lejeune water contamination

The Environmental Protection Agency (EPA) lists chemicals that are hazardous and potentially cause cancer and determines when levels reach an unacceptable health risk. The EPA declared Camp Lejeune a Superfund site (contaminated with hazardous substances) and engaged in a Camp Lejeune cleanup. The Agency for Toxic Substances & Disease Registry (ATSDR) stated that a number of contaminants found in Camp Lejeune drinking water had associations with some types of cancer, birth defects and other health problems. However, ATSDR scientific and clinical research is insufficient to determine whether the degree and length of contamination would indicate a presumption of service associations with certain diseases. The ATSDR expects to have conclusive results in 2013.
