What educational benefits are available under U.S.C. Chapter 35?

The Survivors’ and Dependents’ Assistance Program, established under Chapter 35, provides funding for education and vocational training for dependents of disabled vets and those who died while on active duty or as the result of a service-related condition. Benefits are good for up to 45 months and can be applied to degree and certificate programs, apprenticeships and on-the-job training, as well as correspondence courses. Full-time benefits include:

  • $1,003 a month for institutional training or correspondence courses
  • $732 a month for the first six months for apprenticeship and on-the-job training, with reduced benefits thereafter
  • $807 a month for farm cooperative training
  • $1,003 a month for special restorative training

Funds for part-time education and training are also available. Interested parties must apply through the Veterans Administration. Our veterans’ attorneys assist in filing applications and appealing denials of eligibility.

Obtaining affordable healthcare for your family through CHAMPVA

The Civilian Health and Medical Program of the Department of Veterans Affairs is a comprehensive, low-deductible healthcare program that complies with the Affordable Care Act (ACA). To be eligible for CHAMPVA you must be ineligible for TRICARE, the Department of Defense healthcare program for active duty and retired service members, and you must meet one of the following requirements:

  • Spouse or child of a permanently, totally disabled veteran whose disability is service related
  • Surviving spouse or child of a veteran whose death resulted from a service-related disability or who died while rated permanently, totally disabled from a service-related condition
  • Surviving spouse or child of a service member who died in the line of duty

For many families, the most difficult aspect of establishing eligibility is obtaining a permanent determination of the veteran’s disability rating, either through 100 percent of the schedule or total disability based on individual employability (TDIU).
